UK porn block, will R34 be affected?
This sums it up, will R34 or hentai sites in general face the wrath of the idiotic British government? It definitely violates the part about a site featuring more than 1/3 adult content or expressly marketting itself as adult.

It will only affect the site if it is directly linked to, and operates within, the EU. Not sure where this site primarily operates.

I mean... all the use of copyrighted characters (especially Nintendo and Blizzard properties) will cause a large backlash if that's the case. Even if the material isn't used for profit, it's actually totally illegal to represent these characters in ways not tassetly authorized by their respected owners.

Interestingly, Article 13 (or whatever it's called now) doesn't change copyright law. It only makes the site itself liable for the content it's users upload and utilize.

The site is, to my knowledge, based in San Francisco, CA.

And I think you're getting confused. That's article 13, this is the UK porn block. Basically, the UK gov are going to force porn sites to verify if the user is 18 or over. If they fail to comply, the site can lose its payment schemes or be blocked in the UK. This is supposed to take effect on the 15th July.
Easiest answer is to use a VPN, or y'know, just prove you're 18 or over. I hate it but its something we can get past. (I hope)

Ah, I did assume this was a article 13 issue, but that just means there are 2 pieces of legislation that threaten the site's existence.

If the site is based in San Francisco, then being included in the EU's policies is optional and they can withdraw from it if they choose (as far as I am aware).

The UK porn block sounds much easier to abide by, and shouldn't be much trouble on R34's end, but it would be annoying for users to have to prove their age all the time.

Neither of those pieces if legislation threaten the site’s existence.

Article 13: doesn’t start for another 2 years, will be a bitch to enforce, and only affects characters with companies who care enough to strike down PORN. ONE DMCA AT A TIME WITH THIS SITE’S MODS.

UK porn block: VPNs are free, implementation is easy anyway.

Well - the Porn Laws will require "commercial pornography sites" to hide the site and divert UK visitors to a neutral page where they either sign up - subject to heavy duty verification they are over 18 - before they can view the site - or (presumably) log in and view the site

It is not - in theory - any kind of ban on porn in itself. Just making sites unviewable unless you log in with an account , and requiring strong age-verification if you sign up for one

Now - is this site "commercial" ? Or does hentai count as pornography within the meaning of the Act? They are basically targetting freely visible video real-porn sites like PornHub. RealBoroou might have a problem but R34 not. Even if R34 is covered - and it might not be - it simply requires it to be made members-only from UK IP addresses

If a site refuses to comply, then the British Board of Film Classification can order UK ISPs to block the site .

Frankly R34 is so far down the list of concerns I can't see they'd bother . Its 13 yr olds watching full length gang-bang and bdsm scenes they're panicking about , not hentai images

I'd imagining the cam -sites will just go to "sign up for an account and verify with a credit card purchase" before you can view anything. Whether still-image sites are any kind of priority target I doubt.

And you can simply side-step the lot with a VPN anyway

If Theresa May is too distracted handling Brexit, I don't think the ban would properly come into effect.

Nope, the site is hosted in Amsterdam, the San Francisco endpoint is just Cloudflare CDN.

I'd highly recommend a VPN even if you are of age. Verifying yourself leads to a massive target for hackers and such.
And the UK's cyber security is iffy.
I'm a Brit and am not happy :(

To answer your fears.

The site has a US based server (I ran it through a few server trackers a while back), so you don't need to worry about it being on the site, as long as you can remember the url you'll be fine for visiting it if you're based in the UK. Overall, all that will happen is a lack of search options and the US isn't going to ban porn any time soon.
