I'm pretty sure most of the ToS is just copy-pasted from other boorus. The mods don't seem to take certain parts of it too literally (when they don't ignore them entirely, that is).

I think the one they're referring to (from the upload screen) is the default one from Gelbooru. For the most part, we use the one in the forum.

I checked Furrybooru, which runs the same version of software we do. They have the same ToS on their upload screen as well, word for word, so it must be a default.
